Welcome to Peach Method™. These Terms of Use (“Terms”) govern your access to and use of the Peach Method mobile application, website, and related products and services (collectively, the “Services”). Peach Method is operated by Peach World Co. LLC (“Peach World,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree to these Terms, please do not use the Services.
1. About Peach Method
Peach Method is a self-growth and wellness application designed to provide tools that may help users plan, reflect, express themselves, set goals, build routines, focus, connect with others, and engage in activities related to personal well-being. Features may include planning tools, emotional check-ins, journaling and reflection prompts, goals, focus tools, breathing exercises, wellness activities, and other self-development resources. Peach Method may change, add, remove, or update features over time.
2. Peach Method Is Not Medical or Mental Health Care
Peach Method is designed for general wellness, self-reflection, personal growth, and educational purposes. Peach Method does not provide medical, psychiatric, psychological, therapeutic, diagnostic, or other professional healthcare services. Nothing provided through Peach Method is intended to diagnose a medical or mental health condition; provide treatment; replace therapy, counseling, psychiatric care, or other professional services; provide individualized medical advice; establish a healthcare provider-patient or therapist-client relationship; or provide emergency or crisis services. Content is provided for general informational and self-development purposes. You are responsible for deciding whether and how to use activities presented through Peach Method. If you have questions or concerns regarding your physical or mental health, seek advice from an appropriately qualified professional. Peach Method is not designed to respond to emergencies or crisis situations.
3. Eligibility
You must be at least 13 years old to use Peach Method. By creating an account or using the Services, you represent that you meet the minimum age requirement and are legally permitted to use the Services. If applicable law requires parental or guardian consent for use of the Services or processing of personal information by someone under the age of majority, you are responsible for obtaining any required consent. We may restrict or discontinue access if we reasonably believe that an account is being used in violation of these requirements.
4. Your Account
Certain features of Peach Method may require you to create an account. You agree to provide accurate information when required and to keep your login credentials secure. You are responsible for activity occurring through your account and should not knowingly allow another person to access your account using your credentials. If you believe your account has been accessed without authorization, contact support@peachmethod.app. We reserve the right to suspend or terminate accounts that violate these Terms, threaten the security or operation of the Services, or are used for unlawful or abusive purposes.
5. Your Content
Peach Method may allow you to create and store journal entries, reflections, goals, notes, mood selections, responses to prompts, and other information (“User Content”). You retain ownership of your User Content. By using Peach Method, you give Peach World Co. LLC a limited permission to host, store, process, reproduce, and display User Content only as reasonably necessary to operate, maintain, secure, and provide the Services to you. This permission does not transfer ownership. You are responsible for content you choose to enter and agree not to use the Services to store, upload, or distribute content that violates law, infringes intellectual property or privacy rights, contains malicious code, interferes with operation or security, or is otherwise used unlawfully. Our handling of personal information and User Content is further described in our Privacy Policy.
6. Privacy
Your privacy is important to us. Our Privacy Policy describes the information we collect, how we use and disclose it, our service providers, and available choices. By using Peach Method, you acknowledge that information will be handled as described in the Privacy Policy and applicable law.
7. Paid Features and Subscriptions
Peach Method may offer free and paid features. Prices, subscription periods, features, and material purchase terms will be displayed before purchase. Purchases may be processed through the Apple App Store, Google Play, or another marketplace, and we may use services such as RevenueCat to manage subscription status. Automatically renewing subscriptions renew according to marketplace terms unless canceled before renewal. Deleting the app or account does not necessarily cancel a subscription; manage cancellation through the applicable marketplace. Refunds are generally subject to the marketplace’s policies.
8. Intellectual Property
Except for User Content, Peach Method’s design, graphics, branding, text, prompts, exercises, illustrations, software, features, interfaces, logos, and original content are owned by or licensed to Peach World Co. LLC. Peach Method™ is a trademark used by Peach World Co. LLC. We grant a limited, personal, non-exclusive, non-transferable, revocable license for personal, non-commercial use. You may not copy substantial portions, commercially exploit content, misrepresent affiliation, reverse engineer where prohibited, circumvent security, scrape data, or create a substantially similar competing product in violation of applicable rights.
9. Acceptable Use
You may not use the Services unlawfully or fraudulently, attempt unauthorized access, disrupt operations, introduce harmful technology, circumvent security, overload infrastructure with automation, or impersonate another person. We may act reasonably to protect Peach Method, users, and systems from misuse.
10. Third-Party Services
Peach Method may rely on third-party hosting, authentication, analytics, app distribution, and subscription providers. Third-party services are governed by their own terms and policies, and Peach World Co. LLC is not responsible for third-party products, content, availability, or practices we do not control.
11. Changes to the Services
We may modify, update, add, discontinue, or remove features. We do not guarantee any feature will always remain available, and maintenance or technical interruptions may temporarily affect access.
12. Account Deletion and Termination
You may request or initiate account deletion through app functionality. We may suspend or terminate access for material violations, unlawful activity, misuse, or security risk. Provisions concerning intellectual property, disclaimers, limitations of liability, and disputes survive as permitted by law.
13. Disclaimer of Warranties
To the fullest extent permitted by law, Peach Method and the Services are provided on an “as is” and “as available” basis. We do not guarantee availability, uninterrupted or error-free service, universal device compatibility, no loss of User Content, or any particular personal, wellness, productivity, or other outcome.
14. Limitation of Liability
To the fullest extent permitted by law, Peach World Co. LLC and its owners, officers, employees, contractors, and affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Aggregate liability will not exceed the greater of the amount paid directly during the preceding twelve months or US $100, subject to rights that cannot legally be limited.
15. Indemnification
To the extent permitted by law, you agree to indemnify Peach World Co. LLC and its officers, owners, employees, contractors, and affiliates for claims and reasonable expenses arising from unlawful misuse, violation of these Terms, or infringement of another person’s rights.
16. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where applicable law requires otherwise.
17. Disputes
Before formal proceedings, you and Peach World Co. LLC agree to make a reasonable good-faith effort to resolve disputes informally by contacting support@peachmethod.app. Nothing prevents either party from seeking necessary immediate relief or exercising rights that cannot be restricted by law.
18. Changes to These Terms
We may update these Terms as legal, regulatory, technical, or business requirements change. We will update the effective date and may provide additional notice for material changes. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.
19. Entire Agreement
These Terms, our Privacy Policy, and any additional terms for specific features or purchases constitute the agreement concerning your use of the Services. If a provision is invalid or unenforceable, remaining provisions remain in effect. Failure to enforce a provision does not waive later enforcement.
